Dan is a highly experienced and seasoned trial attorney who has served as lead trial counsel for plaintiffs and defendants in patent, trademark, trade dress, wrongful death, employment, construction, insurance coverage, and business litigation cases in state and federal courts throughout Texas. Dan has also represented clients as lead trial counsel in a variety of matters in Arkansas, Georgia, California, New York, Pennsylvania, Delaware, and Florida. In addition, Dan regularly serves as lead counsel on appeals and has successfully presented oral arguments in front of the Supreme Court of Texas and the United States Court of Appeals for the Fifth Circuit.

As lead trial counsel, Dan has secured jury verdicts in state and federal courts.  He has also successfully obtained judgments for clients through motions for summary judgment and motions to dismiss in state and federal courts. In addition, Dan has provided pro bono legal services as lead counsel for individuals in consumer and civil rights litigation in the Western District of Texas.

Dan currently serves on the Albright Working Group in the Western District of Texas, consulting for and assisting in drafting rules and procedures for managing Waco’s patent docket. He served as Judge Albright’s appointee to the Local Rules Committee for the Western District of Texas and on the Magistrate Selection Committee that led to the appointment of Magistrate Judge Derek Gilliland.

Dan uses his broad litigation experience to assist clients with construction contract negotiations, lien rights issues, human resource planning, and insurance coverage matters.

Dan MacLemore joined the firm as a member in 2019 after 14 years with another litigation firm. He began his legal career as a law clerk to Chief United States District Judge Walter S. Smith Jr. of the Western District of Texas, Waco Division.
